Terms of Use – TrueVibe Wellness

The following Terms of Use (“Terms” or “T&Cs”) govern all use of the https://truevibewellness.co.in website and platform (the “Platform”), including any viewing of content, purchase of services, and use of products available through the Platform (collectively, the “Services”). These Terms apply to all Platform visitors and participants (collectively, “Users”), whether unregistered or registered (“Registered Users”).

By accessing, browsing, or using any part of the Platform, including creating a User Account, you agree to be bound by these Terms. If you do not agree with these Terms (in whole or in part), you must not use the Platform or Services.

1. Platform Overview

Purpose – TrueVibe Wellness provides an informative and educational knowledge-sharing platform related to health like Yoga and health products. Users may:

  • Access online sessions with instructors, view health tips, and track progress.
  • Purchase additional paid services (“Additional Services”) offered by the Platform under separate agreements or purchase terms.

Content – The Platform hosts various content (“Content”), including:

  • Company-created materials such as articles, eBooks, webinars, and online sessions.
  • User-generated content (“UGC”) submitted by Registered Users.
  • Links to third-party websites. The Company has no control over third-party sites and is not responsible for any loss or damage arising from their use.

2. Categories of Users

Users – Anyone visiting or accessing the Platform.
Registered Users – Users who register and create a User Account to access advanced features, contribute content, or participate in online yoga sessions.
Clients – Registered Users who purchase Additional Services (as per purchase-specific T&Cs).

3. Content Provisions

Articles

  • All Users may access articles depending on their User category.
  • Articles may be browsed by topic or category, with related recommendations provided.
  • Articles remain available while the author maintains an active account.

Webinars and Online Sessions

  • Proprietary content of the Company.
  • Accessible only to Registered Users with appropriate permissions.

4. Intellectual Property

  • Ownership – All text, graphics, images, designs, software, audio, video, trademarks, and logos on the Platform are the exclusive property of TrueVibe Wellness or its licensors and are protected by intellectual property laws.

  • Restrictions – Users may not.

    Copy, reproduce, publish, transmit, distribute, display, or create derivative works of Platform materials without written permission
    Use Company trademarks, logos, or the Platform’s “look and feel” without prior authorization
  • License – Upon registration, Users receive a limited, personal, non-transferable, non-exclusive license to access Platform Content for personal use only. Commercial or unlawful use is strictly prohibited.
  • Reservation of Rights – Except as expressly permitted, no rights are granted or implied. All intellectual property rights remain with the Company.

5. Termination

  • User Termination – A Registered User may request account deletion by emailing wellnesstruevibe@gmail.com.
  • Company Termination – The Company may suspend or terminate any User Account at its discretion, with or without notice.

  • Termination for Cause – Accounts may be terminated for reasons including, but not limited to.

    Violation of these Terms or laws
    False or inaccurate account information
    Infringement of third-party rights
    Misuse of Platform features or harmful conduct
    Court orders, authority requests, or repeated unlawful behavior

6. Indemnification

Users agree to indemnify and hold harmless TrueVibe Wellness, its affiliates, employees, contractors, and agents against all claims, damages, liabilities, and expenses (including legal fees) arising from their use of the Platform or breach of these Terms.

7. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Disputes may be subject to the exclusive jurisdiction of the courts in India, unless otherwise specified by the Company.

8. Miscellaneous

These Terms, along with the Privacy Policy, constitute the entire agreement between Users and the Company.

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

Failure to enforce any right does not constitute a waiver.

Users may not assign their rights under these Terms. The Company may assign its rights at its discretion.

The Company reserves the right to modify or update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

9. Terms and conditions related to bonus payments to the users

Eligibility for Referral Bonuses

  • Users must register and maintain an active membership in the program to qualify for referral bonuses.
  • Bonuses are earned only when referred members successfully join and complete any required registration and payment steps.

Referral Levels and Bonus Amounts

  • Bonuses are paid as follows: ₹500 for each direct referral (1st level), ₹300 for each 2nd level referral, ₹200 for each 3rd level, ₹100 for each 4th level, and ₹50 for each 5th level referral.
  • Bonuses will only be credited for valid and legitimate referrals.

No Limit on Referrals

  • There is no cap on the number of users a member can refer at any level.
  • Referral bonuses are calculated on every valid referral across all eligible levels, up to five levels deep.

Qualification and Activity

  • Referral bonuses are contingent upon the referred members maintaining active participation for a minimum 6 months.
  • Bonuses may be withheld or revoked if referrals are found invalid or fraudulent.

Payment Schedule

  • Bonuses will be credited or paid to eligible users twice a month or every 15 days, subject to verification of referrals and compliance with all terms.
  • Payments will be made via the designated payment methods chosen by the user.

Tax and Compliance

  • Users are responsible for any taxes or legal obligations associated with earned bonuses.
  • The company reserves the right to deduct TDS as per the law before processing payments.

Fraud and Abuse Prevention

  • Any form of fraud, spam, multiple accounts, fake referrals, or abuse of the referral system will result in disqualification from bonus payments and potential termination of membership.

Modification or Termination

  • The company reserves the right to modify, suspend, or terminate the referral program or bonus structure at any time without prior notice on the website.

Disputes

  • Any disputes related to referral bonuses will be subject to the company’s final decision.
  • Users agree to resolve disputes through designated arbitration or legal means as outlined in the terms.
